Terms of Use

Article 1 (General Provisions)

  1. These Terms of Use (hereinafter referred to as “these Terms”) set forth the conditions for using the mobile application “My Recipe” (hereinafter referred to as “the Service”) provided by FRAGMENT LLC (hereinafter referred to as “the Company”).

  2. By using the Service, you are deemed to have agreed to these Terms.

  3. If you do not agree to these Terms, you may not use the Service.

Article 2 (Service Content)

  1. The Service is a mobile application that provides recipe storage and management functionality.

  2. Main features:
    • Recipe information retrieval via AI auto-analysis from URLs
    • Recipe storage and management
    • Multiple image upload support
    • Recipe list display in alphabetical or category order
    • Customizable icon settings
    • Recipe detail display and editing functions
  3. Technical components:
    • AI analysis functionality (on-device local processing)
    • Data storage via cloud storage
    • Authentication services (Google Sign In, Sign in with Apple)

Article 3 (User Registration)

  1. Use of the Service requires registration via one of the following authentication methods:
    • Google Account
    • Apple ID
  2. Users are responsible for providing accurate and current information.

  3. One service usage right is granted per authentication account.

  4. Users must be 13 years of age or older.

Article 4 (Usage Rules)

4.1 Prohibited Acts

Users must not engage in the following acts when using the Service:

  1. Violation of Laws
    • Acts that violate laws and regulations in Japan or abroad
    • Acts related to criminal activities
  2. Infringement of Intellectual Property Rights
    • Acts that infringe upon third parties’ copyrights, trademark rights, or other intellectual property rights
    • Unauthorized use of others’ recipes, images, or content
    • Storing others’ recipes without citing sources
  3. Service Disruption
    • Acts that interfere with service operations or server performance
    • Unauthorized access or tampering
    • Acts that exploit vulnerabilities
    • Mass data extraction or scraping
  4. Account Misuse
    • Sharing accounts with third parties
    • Creating multiple accounts for fraudulent purposes
    • Impersonating others
  5. Commercial Use Restrictions
    • Commercial use or redistribution without prior consent from the Company
    • Unauthorized sale or republication of stored recipes
    • Use for competitive business purposes

4.2 Proper Use of AI Features

  1. Users understand that AI recipe extraction may not be 100% accurate.
  2. Users are responsible for verifying the accuracy of extracted recipe information.
  3. AI functionality is processed locally on the user’s device.

Article 5 (Recipe Content)

  1. Users are fully responsible for the recipes they store in the Service.

  2. Users warrant that they have the necessary rights or permissions to store and manage recipe content.

  3. Users must respect the copyrights and intellectual property rights of original recipe creators.

  4. The following types of content are prohibited:

    • Content that infringes upon third-party rights
    • Illegal or harmful content
    • Content containing malicious code or viruses
    • Excessively large files that affect service performance

Article 6 (Intellectual Property Rights)

  1. Intellectual property rights related to the Service (including but not limited to software, design, and logos) belong to the Company or legitimate rights holders.

  2. Users retain intellectual property rights to the recipes and images they upload.

  3. By using the Service, users grant the Company a limited license to store, process, and display content solely for the purpose of providing the Service.

Article 7 (Privacy)

The handling of personal information is subject to the separately defined “Privacy Policy”.

Article 8 (Service Changes and Suspension)

  1. The Company may change or suspend the Service content with prior notice to users.

  2. The Company may temporarily suspend the Service without prior notice in the following cases:
    • System maintenance or upgrades
    • Emergencies
    • Technical issues or security concerns
    • Specification changes to external services (authentication providers, cloud storage)
    • Natural disasters or other force majeure
  3. Except in cases of willful misconduct or gross negligence by the Company, the Company is not liable for damages arising from service changes or suspension.

Article 9 (Usage Restrictions and Suspension)

The Company may restrict or suspend usage if a user falls under any of the following:

  1. Violation of these Terms
  2. Extended period of non-use (12 months or more)
  3. Fraudulent acts or service abuse
  4. Acts harmful to other users or the Company’s operations
  5. Other acts deemed inappropriate by the Company

Article 10 (Data Backup and Loss)

  1. While the Company implements reasonable data backup measures, it does not absolutely guarantee prevention of data loss.

  2. Users are recommended to maintain their own backups for important recipe information.

  3. The Company is not liable for data loss arising from the following cases:

    • User error or device issues
    • Service termination or account deletion
    • Technical failures or force majeure

Article 11 (Disclaimer)

  1. Service Warranty Disclaimer
    • The Company does not guarantee the completeness, accuracy, or reliability of the Service
    • Does not guarantee continuous and uninterrupted service provision
    • AI functionality is provided “as is” and accuracy is not guaranteed
  2. External Content
    • The Company is not responsible for the accuracy, legality, or quality of recipes extracted from external URLs
    • Users are responsible for verifying recipe information
  3. Third-Party Services
    • The Company is not responsible for changes or suspension of authentication providers or cloud storage services
    • The Company is not liable for damages arising from the use of external services
  4. Limitation of Damages
    • To the maximum extent permitted by law, except in cases of willful misconduct or gross negligence by the Company, the Company is not liable for direct or indirect damages arising from the use of the Service
    • The Company’s total liability shall not exceed the amount paid by the user in the past 12 months (if applicable)

Article 12 (Service Termination)

  1. Users may terminate use of the Service at any time by deleting their account.

  2. Upon account deletion:
    • All stored recipe data will be permanently deleted
    • Authentication linkage will be released
    • Access to the Service will end
  3. The Company reserves the right to terminate the Service with reasonable advance notice.

Article 13 (Damages)

If a user violates these Terms and causes damage to the Company or third parties, the user shall be liable for such damages.

Article 14 (Changes to Terms)

  1. The Company may change these Terms as necessary.

  2. Significant changes will be communicated to users through in-app notifications or website announcements.

  3. Continued use of the Service after changes is deemed acceptance of the changed Terms.

  4. If you do not agree to the changed Terms, please stop using the Service.

Article 15 (Governing Law and Jurisdiction)

  1. These Terms are governed by and interpreted in accordance with Japanese law.

  2. For disputes related to the Service, the Tokyo District Court shall be the exclusive court of first instance jurisdiction.

Article 16 (Language)

These Terms are prepared in Japanese. In case of discrepancies with other language versions, the Japanese version shall prevail.

Article 17 (Severability)

If any part of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
